Measures on cultural monuments generally require authorisation under monument protection law. Authorisation is also required for the construction, alteration or removal of buildings or garden and landscaping installations in the vicinity of a cultural monument. Other projects in the vicinity of a cultural monument require authorisation if the previous use of the property would change.
Only if a building permit is required for your project does this replace the authorisation under monument protection law. The responsible building supervisory authority will obtain the approval of the monument protection authority as part of the authorisation procedure.
With the application, you must submit the documents that the authority requires to assess your project and that it needs to process the application. These can be
- Plans
- Documentation
- Photographs
- Expert reports
- Cost and profitability calculations
In individual cases, the authority may also require the application to be supplemented by preparatory investigations. It is advisable to discuss the details with the monument protection authority in advance.
- Alteration or removal of a cultural monument
- Consrtuction, alteration or removal of buildings or garden and landscape design installations in the vicinity of a cultural monument
- Procedural fee: EUR 40.00 - 400.00
- for destruction or removal of the monument: EUR 40.00 - 600.00
Apply in writing to the monument protection authority ("competent authority") for a licence under monument protection law. You can obtain the necessary forms from Amt24 (after selecting the location) or directly from the monument protection authority.
- The monument protection authority decides on the granting or refusal of a monument protection licence.
- The licence can be approved as applied for, subject to conditions or other ancillary provisions or even refused altogether.
- The decision is made in consultation with the State Office for Archaeology (Landesamt für Archäologie) and the State Office for the Preservation of Monuments (Landesamt für Denkmalpflege).
Fictitious authorisation
If the heritage protection authority does not make a decision within two months of receiving your application, your project is deemed to have been approved and you may begin. However, this is not the case if the authority subsequently requests the necessary documents within the two months or suspends the procedure (for example, if preparatory investigations are required to assess the project).
Lapse of the authorisation
- if construction has not started: 3 years after authorisation
- if construction is interrupted for more than 2 years
(extension of up to 2 years upon written application)
