Notification in accordance with Section 65 (4) of the Saxon Building Code (Sächsische Bauordnung/SächsBO)
Persons who are established in another member state of the European Union, another contracting state of the Agreement on the European Economic Area or Switzerland as persons authorised to submit building documents are authorised to submit building documents without being entered in the list in accordance with Paragraph 2 No. 2 if they:
- possess a comparable authorisation and
- have had to fulfil requirements comparable to those of paragraph 3, sentence 1, nos. 1 and 2.
They must notify the Saxony Chamber of Engineers (Ingeneurkammer Sachsen) in advance of their first activity as a person authorised to submit building documents.
Upon application, the Saxony Chamber of Engineers shall confirm that the notification pursuant to sentence 2 has been made; it may prohibit the person from acting as a person authorised to submit building documents and delete the entry in the register pursuant to sentence 2 if the requirements of sentence 1 are not met. § Section 71a VwVfG (Verwaltungsverfahrensgesetz) shall apply.
Persons who are established in another Member State of the European Union, another Contracting State to the Agreement on the European Economic Area or Switzerland as being authorised to prepare fire protection certificates without being comparable within the meaning of section 66 (2) are qualified fire protection planners if the Saxony Chamber of Engineers has certified that they meet the requirements of section 66 (2); they shall be listed in a register. The certificate shall be issued upon application. Paragraph 2 shall apply accordingly.
Notifications and certificates in accordance with section 66(2) sentence 6 in conjunction with section 65(5) are not required if a notification has already been made or a certificate has been issued in another Land; no further entry is made in the registers kept by the Saxony Chamber of Engineers.
- Certification that they are legally established in a member state of the European Union, another contracting state to the Agreement on the European Economic Area or Switzerland for the preparation of fire protection certificates and that they are not prohibited, even temporarily, from carrying out these activities at the time of submission of the certificate.
- Proof that they had to fulfil at least the requirements of § 66 Paragraph 2 in the state of their establishment for the activity as a qualified fire protection planner.

- The notification shall be made in writing and informally.
- Upon request, the recognition authority shall confirm that the notification has been made.
- The recognition authority shall prohibit the activity if the above requirements are not met.
