If, in exceptional cases, it is not certain whether a building is actually a cultural monument, you can have this status determined by a binding decision.
In principle, all cultural monuments are included in lists of cultural monuments. However, inclusion in the lists of cultural monuments has no legal effect. It is not decisive for the question of whether the building is a cultural monument.
Together with the application, you must submit the documents that the authorities require for their assessment. It is advisable to discuss the details with the monument protection authority in advance.
Only the owner of the property may submit the application.
A building is a cultural monument if the requirements of Section 2 of the Saxon Monument Protection Act are met. For this purpose, the building must qualify as a monument and be worthy of preservation:
- monument eligibility: The object must have at least historical, artistic, scientific, urban planning or landscape design significance.
- monument worthiness: An object that is eligible as a monument is only worthy of being listed if there is a public interest in preserving it. Not every listed building is worthy of preservation, but only if the interest in preserving the cultural monument has gained significance for the general public beyond subjective individual interests.
You must apply to the lower monument protection authority to have your building recognised as a cultural monument.

In agreement with the State Office for the Preservation of Monuments, the monument protection authority will check whether the building is a cultural monument. As a result of the examination, you will receive a notice of assessment.
