Applying for permission to exhibit persons according to § 33a Gewerbeordnung (GewO) (Trade, Commerce and Industry Regulation Act)

If you want to organize commercial exhibitions of persons, for example table dancing or striptease events, on your business premises or make your business premises available for such events, you need a permit from the relevant trade authority. This does not apply to performances of a predominantly artistic, sporting, acrobatic or similar nature (Section 33a (1) sentence 2 GewO).

• Certificate of good conduct (original)
• Extract from the Central Trade Register (original)
• Certificate in tax matters from the tax office (original)
• Extract from the commercial register (copy)
• Documents on the object (floor plan of the business premises (copy)

• You must have the necessary reliability for the business operation.
• The exhibitions must not be contrary to public morals.
• The business operation must not be contrary to the public interest with regard to its local location or the use of the premises; in particular, there must be no fear of harmful effects on the environment (e.g. noise) or other significant disadvantages, dangers or nuisances for the general public.

You can apply for a permit for the exhibition of persons in person, in writing or electronically to the competent authority.

The authority can issue the permit with a time limit and link it with conditions for the protection of

• the general public,
• guests or
• neighbors.

Under the same conditions, the subsequent inclusion, amendment and addition of conditions is also permitted.

Application processing and decision: within 3 months after receipt of the complete documents.

You must apply for the permit before starting the activity. Only after the permission is granted, you are entitled to practice your business.
