The business form of a European Economic Interest Grouping (EEIG) is intended to enable small and medium-sized enterprises from EU member states to engage in cross-border co-operation.
Purpose of an EEIG
The purpose of an EEIG is to facilitate or develop the economic activities of its members by pooling resources, activities or experience. The EEIG must have its registered office within the Community.
The purpose of the association is not to make a profit for itself. Rather, this must be shared and taxed between the members. The activities of the EEIG must be related to the economic activities of its members and may only be ancillary to these activities.
Formation of an EEIG
An EEIG can be formed by companies and other entities under public or private law in accordance with the national law of a member state.
It may be formed by natural persons who have a
- commercial,
- commercial,
- craft,
- agricultural or
- professional
Activities in the Community or provide other services there.
An EEIG must consist of at least two members from different member states, but cannot employ more than 500 people.
EEIG formation agreement
The articles of association of an EEIG must contain the name, registered office, object and, where applicable, the name, registration number and place of registration of each member of the association, as well as the duration of the association, unless it is indefinite. This agreement must be entered in the register provided for this purpose by each Member State. Registration confers full legal capacity on the EEIG throughout the Community.
Note: Whenever an EEIG is formed or dissolved, the details must be published in the Official Journal of the European Communities.

To submit an application, contact a notary*.
- The notary will advise you on how to formulate the application.
- The application is made exclusively electronically and a publicly notarised document is created for this purpose. From 1 August 2022, the document can also be notarised via video communication.
- The declaration is provided with an electronic signature and sent to the electronic court and administrative mailbox of the registry court.
Amendments
Have key details about your company, such as the registered office, legal form or authorised representatives, changed? Then have the commercial register entry corrected immediately.
The entry is made in the same way exclusively via a notary.

If the registry court refuses to enter the EEIG formation agreement in the commercial register, an appeal may be lodged pursuant to section 382 (4) sentence 2 FamFG in accordance with section 58 (1) FamFG or, if applicable, an appeal on points of law pursuant to section 70 (1) FamFG.
