Authorisation to use the professional title in the name of a foreign company according to § 11 Saxon Architects Act (Sächsisches Architektengesetz/SächsArchG)
A company that does not have its registered office in the Federal Republic of Germany (foreign company) may use the professional title "Architekt / Architektin", "Innenarchitekt / Innenarchitektin", "Landschaftsarchitekt / Landschaftsarchitektin" or "Stadtplaner / Stadtplanerin", which is protected in Saxony, in its name or in the name of its company, even without being registered in the company register, if it is authorised under the law of its state of origin to use this or a similar professional title in its name or in its name.
To do so, however, you must notify the Saxony Chamber of Architects (Architektenkammer Sachsen) of your service activity. The Chamber of Architects will then check whether the legally stipulated requirements for using the professional title are met. If this is the case, the company is listed in a special register.
Notification is not required if the foreign company is entitled to use the professional title on the basis of the law of another federal state.
The company does not become a compulsory member of the Saxony Chamber of Architects. Professional duties apply.

For this procedure, you can make use of the service of the point of single contact. This person will guide you through the procedure, take care of the correspondence with all the offices responsible for your matter and will be available to you as a competent advisor.

Upon request of the Saxony Chamber of Architects additionally:
- Proof that the company or its partners and legal representatives are legally exercising the activity in question according to the law of the company's country of origin
- Proof that the company fulfils the requirements to bear the professional title in its name
- Proof of registered office outside the Federal Republic of Germany (single copy)
- Memorandum or Articles of Association (single copy)
- Proof of liability insurance (single copy)
- Registered office of the company outside the Federal Republic of Germany
- Authorisation under the law of the country of origin to use the professional title "architect", "interior architect", "landscape architect", "urban planner" or a comparable professional title in the company's name
- sufficient liability insurance
- Regulation according to the articles of association or statutes that the majority of the company is formed and represented by members of the profession or jointly with consulting engineers (for further requirements see § 9 Para. 3 SächsArchG)
- Notification of the first provision of services has been submitted to the Saxony Chamber of Architects
Notes:
- Companies that do not have their registered office, head office or principal place of business in a member state of the European Union may be prohibited from using the professional title if reciprocity of recognition is not guaranteed.
- The Saxon Architects Act contains detailed regulations on the above-mentioned requirements (see legal basis).
Before you provide services in the Free State of Saxony for the first time, notify the Chamber of Architects of Saxony. Upon receipt of the notification, you have the right to use the professional title in the name of the society for an unlimited period of time.
- Inform the Saxony Chamber of Architects that you wish to provide the service for the first time; enclose the required documents with your informal letter.
- The Chamber of Architects will immediately confirm receipt of the documents and inform you of any missing documents.
- Provided you meet the requirements, you will receive a certificate of authorisation to use the professional title.
Under certain conditions, the Saxony Chamber of Architects may prohibit you from using the professional title (see legal basis).
