Submission of documents for entry in the register of associations to the register court
Documents for entries in the register of associations are accepted by the registry court responsible for the location of the association's registered office. In Saxony, the local courts of Chemnitz, Dresden and Leipzig are responsible for keeping the register of associations. The declaration for the application for entry in the register must be notarised. You are free to choose your own notary.
- publicly notarised declaration of registration
- Copy of the articles of association
- Copy of the documents concerning the appointment of the board of directors
Note: Depending on the content of the articles of association, further documents may be required. It is therefore advisable to coordinate both the draft articles of association and the procedure in connection with the registration with the responsible judicial officer at the register of associations in advance.
- The notarised declarations of the members of the Management Board authorised to represent the company have been submitted for entry in the register.
The costs for an application for entry in the register of associations vary depending on the individual case:
- Fee for entry in the register of associations and publication costs
- if applicable, costs for drafting the articles of association and preparing the application
- further costs (depending on the value of the item) if the notary's office is also commissioned to send the notarised documents to the register court
If instructed, the notary's office, which also notarises the registration declarations, submits all documents for entry in the register of associations to the competent registry court.
- You can still submit the notarised declarations with the other documents in paper form to the registry court yourself.
- You will be informed when the entry has been made.
Changes
Have important details about your association, such as the registered office or authorised representatives, changed? Then please have the register entry corrected immediately.
The entry is made in the same way as the application.
If the registration court refuses entry in the register of associations, an appeal may be lodged in accordance with Section 382 (4) sentence 2 FamFG pursuant to Section 58 (1) FamFG or, if applicable, an appeal on points of law pursuant to Section 70 (1) FamFG.
