- § 9 Sächsisches Gaststättengesetz (SächsGastG) – Sperrzeit
- Sächsisches Kostenverzeichnis (SächsKVZ) - Anlage 1, Nr. 43 Gaststättenwesen
Upon application, the trade authority can authorise exceptions to the closing time if there are corresponding public needs or special local conditions.
In order to protect the population from persistent noise pollution, a closing time has been set for restaurants and public entertainment venues in Saxony. It begins at 05:00 and ends at 06:00. For certain types of establishments (e.g. amusement arcades and public entertainment venues at funfairs and fairgrounds), the closing time begins at 23:00 and ends at 06:00.
Closing time is the period of time during which no services are provided to guests by the establishment and no guests may be present in the premises.
If there is a public need or special local circumstances, the city or municipality may
- generally extend, shorten or cancel the closing time by statutory order and
- on application for individual establishments
- bring forward the start of the closing time to 8 p.m. at the earliest,
- postpone the end of the closing time until 7 a.m,
- shorten the closing time or
- cancel the closing time.
Exceptions:
- On the nights of 1 January, 1 May and 2 May, the curfew is lifted by law.
- For businesses and events at public festivals and markets, the "opening hours" are already regulated as part of the organisation of the event concerned.
Special Features:
- The regulations of the Sächsisches Sonn- und Feiertagsgesetz remain unaffected, according to which certain events are generally prohibited on particularly protected public holidays, days of remembrance and mourning (such as Good Friday, Day of Prayer and Repentance, Memorial Day, Sunday of the Dead). The district police authorities may exempt from the ban in individual cases for good cause.
- Closing times for amusement arcades may not be less than three hours.
