Parties may submit nominations. If the parties are not represented in a Land parliament or in the Bundestag and the Federal Electoral Committee did not determine their party status at the last election to the German Bundestag, they must first notify the Land returning officer in writing that they will take part in the election.
The notification of participation in the election must include
- the name and abbreviation under which the party will participate in the election and
- the handwritten signatures of at least three members of the provincial executive committee, including the chairman or his deputy or, if a provincial association does not exist, the executive committees of the next lower-ranking regional associations.
The following documents must be attached to the notification:
- the written statutes and the written programme of the party
- proof of the appointment of the executive committee in accordance with the statutes
Please note! All information and documents must be complete. After expiry of the notification period, only defects in valid notifications can be rectified.
A notification of participation is required if
- the party is neither represented in the German Bundestag nor in a Land parliament on the 90th day before the election on the basis of its own nominations and
- its party status was not established by the Federal Electoral Committee at the last Bundestag election.
Submission
- The party declares in writing that it will participate in the election and submits the required documents in full.
- The Land returning officer notes the date of receipt on each notification of participation and immediately checks whether it fulfils the requirements of the law (preliminary examination).
Rectification of defects
- If the state returning officer identifies any deficiencies, he shall immediately notify the party executive committee and request that it rectify any remediable deficiencies in good time.
- After the decision of the State Election Committee on the determination of party status, any rectification of defects is excluded.
Examination and authorisation
- The Land returning officer shall invite the parties that have notified their participation in the election to the meeting at which a decision is made on their recognition as a party for the election. He submits the notifications of participation to the State Electoral Committee and reports on the result of the preliminary examination.
- Before the decision is made, the parties involved are given the opportunity to comment.
- The state electoral committee determines with binding effect for all electoral bodies
- which parties are represented in parliament,
- the parties for which the Federal Electoral Committee established party status at the last election to the German Bundestag,
- which associations that have notified their participation are to be recognised as parties for the election.
Announcement
- Following the determination, the Land returning officer announces the decision of the Land electoral committee at the meeting and briefly states the reasons. The decision is made public.
- Receipt of the notification of voter participation (with all required information and documents): no later than the 90th day before the election by 6:00 p.m. at the state election officer
- Determination by the state electoral committee as to which association is recognised as a party: no later than the 72nd day before the election
The party executive committee concerned may appeal to the State Election Committee against decisions of the State Returning Officer in the procedure for rectifying defects.
