If you want to found a new party, you must issue a public invitation to the founding meeting. At least three people are required to found a party (prerequisite for a secret ballot). The party program and statutes are adopted at the meeting. In order to represent the party externally, an executive committee must be elected (appointment of the national executive committee in accordance with the statutes). The executive committee must consist of at least three members.
Note:
Minutes of the founding meeting must be drawn up. The minutes must include Members present, place, date, time of the meeting, keeper of the minutes, agenda of the meeting, signature of the keeper of the minutes.
The newly founded party must then register with the Federal Returning Officer and file its documents. He checks whether the program and statutes meet the minimum requirements set out in the Political Parties Act and whether everything is complete.
After the founding meeting, the actual work for the party begins: recruiting new members, establishing structures, founding local, district or state associations and taking part in elections. The party gets involved in current political debates, states its positions, proposes solutions and draws up an election program.
A party loses its legal status as a party if it has not participated in a Bundestag or Land parliamentary election with its own election proposals for a period of six years, and before the election the respective election committees check whether the party can be admitted to the upcoming election (European, Bundestag, Land or local elections).
