If you or your company dispose of waste or are involved in disposal processes for which you have to keep records and/or registers, you can apply for exemption from these record-keeping or register obligations.
You must document the proper disposal of waste. To this end, the Closed Substance Cycle Waste Management Act regulates obligations to keep records and registers.
The obligations to keep records and registers do not apply to waste generated in private households.
You or your company must keep records and registers if you
- generate,
- collect,
- transport or
- dispose of it
This applies to
- hazardous waste
- non-hazardous waste containing POPs
You or your company are also subject to the obligation to register if you
- broker or trade in hazardous waste or
- dispose of non-hazardous waste as an operator of facilities.
You can apply for exemption from the obligation to keep records or register.

Whether an exemption from verification or registration obligations can be granted is a discretionary decision by the competent authority.
You or your company can only be granted this exemption if there is no reason to fear any detriment to the public interest. In principle, there is a great public interest in keeping records and registers. The authority will therefore check whether your application does not conflict with this interest.
- You or your company can submit the application for exemption from verification or registration obligations in writing (informally) to the competent authority. Alternatively, you can use the eBNUR online service. Enclose all information necessary for the assessment of the facts with the application.
- The competent authority will process your application and decide whether an exemption can be considered.
- You will be notified of the authority's decision.

The legal remedy depends on the authority responsible for your application.
You can file an appeal with the administrative court against the decision of the Saxony-Anhalt State Administration Office or the Saxony-Anhalt State Office for Geology and Mining.
You can lodge an appeal against the decision of the district or independent city.
