The employment of persons who work with third-party X-ray equipment or third-party interference sources and who may be exposed to a dose higher than 1 mSv must be reported to the competent authority.

If a company allows its employees to work in other companies and the employees can receive more than 1 mSv (effective dose) to the interference emitter or X-ray equipment there in a calendar year, then the external company to which the employees are sent is a "third-party X-ray facility or third-party interference emitter".

The posting company must notify the competent authority of its employment in the third-party X-ray facility and requires radiation protection officers with appropriate expertise. Holders of a permit for employment requiring approval in third-party installations or facilities are exempt from the notification obligation.

• Copy of the application for a police clearance certificate for the person responsible for radiation protection
• Copy of the application for a police clearance certificate for the radiation protection officer(s)
• Written appointment of the radiation protection officer(s) by the radiation protection officer or persons responsible for radiation protection, stating the internal decision-making area
• Proof of expertise (and, if necessary, updating) in radiation protection for the radiation protection officer or the radiation protection officer or the radiation protection officer, if no radiation protection officer or radiation protection officer is necessary
• Radiation protection instruction
• Delimitation agreement with the operator of the third-party plant or facility

The requirements are met if:

1. An application must be made to the competent reporting authorities for a police clearance certificate of document type O (certificate of good conduct by the authorities) for the person responsible for radiation protection (applicant or legal representation of the applicant in the case of legal entities) and for the radiation protection officer. Certificates of good conduct which are sent directly to the competent authority shall be marked as follows:

2. The written appointment of the radiation protection officer by the radiation protection officer, stating the internal decision-making area of the radiation protection officer in the applicant's company.

3. Proof of the expertise of the radiation protection officer(s) in radiation protection by presenting a certificate of expertise (expert knowledge group R9/R10 (if S5 expertise is available, the RG module must be completed once again)).

4. A radiation protection instruction which, in addition to the instructions, ensures that the persons under supervision have the necessary knowledge of possible radiation hazards and protective measures to be applied.

• In particular, the radiation protection instruction must contain the following points:
  • The establishment of a plan for the organization of radiation protection, taking into account instruction, medical supervision, keeping of radiation passports and the use of the necessary dosimeters.
  • The regulation of the operational sequence essential for radiation protection.
  • The regular functional inspection and maintenance of equipment, installations and other devices that are essential for radiation protection, provided that they are provided by the applicant, as well as keeping records thereof.

5. Delimitation Agreement

A temporary employment contract is another possibility, provided that it lays down appropriate regulations regarding radiation protection and the authority to issue instructions.

6. No Reliability Concerns

There are no concerns about the reliability of the person obliged to report, their legal representation or, in the case of legal entities, the persons authorized to represent or the radiation protection officer.

• Prior to employment in connection with the operation of third-party X-ray equipment or interference emitters, all necessary evidence must be provided by the competent authority.
• You can submit the evidence by post to the competent authority using the notification form.
• If the competent authority does not object to the evidence you have submitted, you can start the activity.

Before commencing/starting work

If the authority prohibits employment, you can file a lawsuit.
