If you intend to make changes to an installation requiring a permit that are relevant to an incident, you must first apply to the responsible authority for a permit.

Do you operate a plant subject to immission control approval that constitutes an operating area or is part of an operating area and are you planning to make changes to the plant that are relevant to incidents?

These plans can lead to a significant increase in danger being triggered by the plant as a result of the change or to other immission protection requirements no longer being guaranteed.

Against this background, the immission control authority must review these changes.

For this purpose, you must submit an application for a modification permit and submit all the documents required for the assessment. The application can be made in writing or electronically.

However, a permit is not required if and to the extent that the obligation to maintain the appropriate safety distance is already ensured at the level of a spatially significant planning or measure by binding specifications.

The modification permit is issued if:

• it is ensured that the obligations resulting from the requirements of the Federal Immission Control Act and the Federal Immission Control Ordinance are fulfilled, and
• other regulations under public law and occupational health and safety concerns do not conflict with the construction and operation of the plant.

You submit an application to the responsible authority for approval of the changes relevant to the incident. You can submit the application electronically or in writing.

The application must be accompanied by the documents required to assess the facts of the case. After receipt of the application and the complete documents, the competent authority checks whether the changes meet the requirements of immission protection law.

Depending on whether public participation is required or not, the authority will decide on your application within 3 or 7 months after complete receipt of all required documents. After final assessment by the competent authority, you will receive the decision in the form of an official notice.

• A permit is required for accident-relevant modifications to installations requiring a permit that are an operating area or part of an operating area:
  • if the appropriate safety distance to neighboring protected objects is undercut for the first time as a result of the incident-relevant modification,
  • the safety distance that has already been undercut is further undercut spatially, or
  • a considerable increase in danger is triggered and
  • the change is not already covered by § 16 Para. 1 BImSchG.
• Approval is not required if and insofar as the requirement to maintain the appropriate safety distance is already taken into account by other binding specifications.
