Certain properties are exempt from this booking obligation, e.B. land of the federal government, the states, the municipalities, the churches or public roads.

A property that is exempt from the booking obligation, but is nevertheless registered in the land register, can be withdrawn from the land register at the request of the owner, i.e. fully booked. This presupposes that there are no encumbrances on the property.

Written application by the owner stating the land in question

• The (new) owner is exempt from the booking obligation in accordance with § 3 paragraph 2 GBO. These are the federal government, the states, the municipalities and other municipal associations, the churches, monasteries and schools, owners of watercourses, public roads, as well as land dedicated to a railway company serving public transport.
• Registrations that affect the right of the owner are not available.
• The rights in Division II and Division III have been deleted.

There is no charge for deregistration.

The derecognition note of the land registry office must be entered in the inventory of the land register. If all land entered on a sheet is fully booked, the sheet must be closed.
