If you wish to act as an examination body for examinations of biowaste recycling on soil (biowaste treatment, biowaste, soil) in the waste management sector, you must be designated as such by the competent authority.

When recycling biowaste on soil, for example as compost or digestate, operators of biowaste treatment plants and plants for the production of mixtures containing biowaste must have various tests carried out, including sampling and sample preparation.

These tests include

• One-off testing of the process for the hygienization of biowaste,
• regular testing of the hygiene status of untreated, partially treated and treated biowaste,
• regular testing of untreated, partially treated and treated biowaste as well as mixtures produced with biowaste for heavy metal content, foreign substance content and other parameters,
• testing untreated, partially treated and treated biowaste as well as mixtures produced with biowaste for certain other pollutants as required,
• testing of ordered reserve samples of untreated, partially treated and treated biowaste and mixtures produced with biowaste for heavy metal content, foreign substance content, other parameters and certain other pollutants as required,
• one-off testing of the soil when untreated, partially treated and treated biowaste or mixtures produced with biowaste are applied for the first time.

Testing bodies, such as laboratories or other specialized bodies, check compliance regularly or as required.

If you wish to carry out tests for the recycling of biowaste on soil, you must apply to the competent authority of the federal state to designate you as an inspection body. The designation applies to the entire federal territory.

• Evidence and information on the required expertise, independence, reliability and technical equipment. Measures for quality assurance and quality control, including proof of regular successful participation in interlaboratory comparisons. You may be required to submit further documents following queries from the competent authority.
• If you are active nationwide, the authority may require you to submit a valid accreditation confirming compliance with the requirements of DIN EN ISO/IEC 17025:2005 relating to the parameters and test procedures.
• Equivalent recognitions and certificates from another member state of the European Union or another state party to the Agreement on the European Economic Area are possible if they show that comparable requirements are met.

• You have the necessary expertise, independence, reliability and technical equipment and carry out quality assurance and quality control measures, including regular successful participation in interlaboratory comparisons.
• You have submitted the application in the federal state in which you have your registered office. If this is located abroad, you submit the application in the federal state in which you primarily wish to carry out this activity.

You must submit an informal application to the authority of the federal state in which you have your registered office to be designated as an inspection body for the selected inspection object or area (also several) at the
biowaste recycling on soil. If your place of business is abroad, you must submit the application in the federal state in which you will primarily carry out the testing activities.

Proceed as follows:

• Create the informal application and attach the required documents. If necessary, the authority will request further documents and evidence.
• If you wish to enclose equivalent recognitions and certificates from another member state of the European Union or another state party to the Agreement on the European Economic Area with the application, these documents must be submitted before you take up the activity.
  The authority may request a certified German translation of foreign equivalent recognitions and certificates.
• After examination by the competent authority, you will receive a written decision as to whether you have been designated as an inspection body.
• The authority can attach a reservation of revocation, a time limit, conditions, requirements and the reservation of requirements to the designation.
• The notification is then made via the Research System for Measuring Bodies and Experts of the Federal States (ReSyMeSa).
