Before the start of the construction of an operating area or if your operating area is to be changed in a relevant manner, you must notify the competent authority in advance.

As the operator of an operating area in accordance with the Hazardous Incident Ordinance, you are obliged to report the information listed in § 7 of the Hazardous Incident Ordinance to the competent authority at least one month before the start of the construction of the operating area or before an accident-relevant change. A separate notification is not required if you have submitted the information to the competent authority as part of an approval or notification procedure.

The display shall contain the following information:

1. the name or business name of the operator and the full address of the operating area concerned,
2. registered office and full address of the operator,
3. the name and function of the person responsible for the operating area, if different from the person referred to in point 1;
4. sufficient information to identify the hazardous substances and the hazard category of substances,
5. the quantity and physical form of hazardous substances,
6. activity or intended activity in the installations of the operating area,
7. Circumstances in the immediate vicinity of the operating area which may cause an incident or aggravate its consequences, including, where available, details of:
   • adjacent operating areas
   • other permanent establishments not falling within the scope of this Regulation; and
   • Areas and developments from which an incident could emanate or where the probability of an incident occurring may increase or the effects of an incident and domino effects may worsen

The notification shall be submitted in writing by post or electronically to the competent authority.

The notification shall be submitted to the competent authority at least one month before the start of the construction of the operating area or before any change relevant to an incident.

This administrative service does not constitute an administrative act. For this reason, there is no remedy.
