If you are a natural person or if legal persons and companies without legal personality wish to provide legal services in the following areas on the basis of special expertise, you must register with the competent authority:

• debt collection services

• Pension advice in the field of
  • statutory pension and accident insurance
  • social compensation law,
  • other social insurance and disability law relating to a statutory pension and
  • company and occupational pension schemes

• Legal services in a foreign law:
  In this case, you must note the following:
  
  If the foreign law is the law of a member state of the European Union (EU), another state party to the Agreement on the European Economic Area (EEA) or Switzerland, you may also provide legal advice in the area of EU law and the law of the EEA.

If you are registered with the competent authority with a foreign legal qualification pursuant to Section 10 (1) No. 3 RDG, you may provide extrajudicial legal services in the respective foreign law.

• Application for registration in accordance with the Legal Services Act
• Documents proving your theoretical and practical expertise
• a summary of your training and the exercise of your profession to date
• a certificate of good conduct in accordance with § 30 para. 5 BZRG

If the personal suitability and reliability as well as the theoretical and practical expertise are available, the registration authority will ask you for proof of professional liability insurance.

Prerequisite for registration pursuant to § 10 para. 1 no. 3 RDG

• Personal suitability and reliability
• Completion of professional liability insurance
• Proof of special theoretical and practical expertise in the relevant foreign law, Section 12 (1) No. 2 RDG.
• Required expertise:
  • You are or were legally established as a lawyer or in a comparable legal profession in the respective country.
  • You must prove this by means of a corresponding certificate from the authorities in your country of origin, Section 2 (3) sentence 1, Section 3 (2) RDV.
  • In addition, you can also provide proof of theoretical expertise by means of a degree certificate from a foreign university for a three-year course of study with predominantly legal content, Section 2 (3) sentence 2 RDV.
  • You can also provide evidence of practical expertise in the form of certificates of at least two years of supervised professional practice or practical professional training, Section 3 (1) sentence 2 RDV.

If you have acquired a European professional qualification (in accordance with Section 12 (3) sentence 4 RDG) in another EU member state or state party to the Agreement on the European Economic Area, you can also prove your theoretical expertise (taking into account the existing professional qualification) through an adaptation course.

In cases of European professional qualification (see above, Section 12 (3) sentence 4 RDG), you must provide suitable documents, in particular a certificate from a foreign authority, to prove that the requirements of Section 12 (3) sentence 4 RDG have been met. In addition, separate proof of theoretical expertise is not required.

• Submit the application with the application documents to the responsible office.

The submission of a translation may be required for certificates and documents that are not issued in German, Section 6 (4) RDV.
