If you would like to swap agricultural or forestry plots (or parts thereof) with one or more partners, you can submit an application for a voluntary land swap in accordance with the Land Consolidation Act to Department 33 of the district government in whose district the land is predominantly located.

You can voluntarily exchange at least one agricultural or forestry parcel (or parts thereof) with one or more exchange partners (voluntary land exchange). This procedure is managed by the land consolidation authority. As a rule, entire parcels of land are exchanged without the need for surveying. You agree with the exchange partners on the exchange of the parcels and on any associated (financial) compensation. You have a fundamental right to object to the regulations of the voluntary land swap. However, this procedure would not be expedient, as the land swap cannot be realized without mutual agreement.

Voraussetzungen

A written application is a prerequisite for the implementation of a voluntary land swap in accordance with the Land Consolidation Act. As the owner or as a legal entity managing property, you wish to swap agricultural or forestry land (if necessary with a corresponding power of attorney).

Kosten

The procedural costs, for example for actions by the land consolidation authority, are borne by the state. If a pure exchange of parcels of land takes place without value compensation, there are usually no costs for the exchange partners. If financial compensation is required between the exchange partners in the voluntary land swap, taxes may be payable to the tax authorities. Any implementation costs incurred in individual cases (e.g. surveying costs or costs for preparing the exchange areas) are borne by you as the exchange partner. If necessary, you can apply for funding for any surveying costs. These depend on the regulations of the currently valid state funding guidelines.

Verfahrensablauf

If at least two exchange partners have come together to exchange their land ownership in a voluntary land exchange in accordance with the Land Consolidation Act, they can apply to the land consolidation authority to carry out such a voluntary land exchange. An online service is also available for this purpose. After submitting the application online, you will receive an automatic confirmation of receipt. The competent authority checks whether the requirements for ordering a voluntary land swap have been met, then communicates with the swap partners and decides whether to order the voluntary land swap.

Due to the complexity of the procedure, the land consolidation authority will contact you directly after the online application. All further actions required by the land consolidation authority in the procedure are carried out in consultation with the exchange partners.

Bearbeitungsdauer

The procedure can take several months, or even several years if the situation is complicated.

Frist

As this is not an officially required service, there are no deadlines set by the land consolidation authority. The deadlines to be met by you only exist during the further processing of the procedure as part of the general administrative action of the authority. If the exchange partners do not comply with these deadlines, the land consolidation authority must question the voluntary nature and thus the feasibility of the voluntary land exchange under the Land Consolidation Act and, if necessary, reject your application or discontinue the procedure.
