You can use public roads for other purposes than just traffic. As a rule, you need a special use permit for this.
Special uses of public roads are extremely varied. Examples of such special uses can be
- Setting up goods and information stands
- Putting up posters
- Installation of business signs or advertising systems that do not protrude slightly into the airspace
- Operation of outdoor catering
- the practice of street art
- Erecting construction fences or construction cranes
- Crossing footpaths (lowering of kerbs)
You must also apply for a permit to use the airspace above the road (e.g. for advertising structures).
Any use of the public traffic area in excess of the permission granted constitutes an administrative offense under Section 59 of the NRW Roads and Paths Act, which can be punished with a fine.
Depending on the type of special use, the competent authority may request documents and evidence.
You must apply for a special use permit from the responsible authority.
Above all, it checks what effects a permit would have on the use of the road.
The intended special use must not
- interfere too much with the public use of others,
- cause a nuisance to pedestrians or residents through noise,
- pollute the street excessively or
- impair the townscape
After your application has been reviewed, you will receive a notice of approval or rejection.
The competent authority will limit the permit in time or grant it revocably. It may impose conditions and requirements.
Special use may only begin once permission has been granted by the responsible authority.
You do not need a special use permit if you have a building permit.
