Every death must be reported to the registry office responsible for the place of death.
If someone dies in a hospital, nursing home or prison, the owner of the facility must report the death in writing.
In the event of an unnatural or unexplained cause of death, the death must be reported to the relevant police authority once the investigation has been completed.
In all other cases, the following persons are obliged to report the death (verbally) in the following order:
- any person who lived in the same household as the deceased,
- the person in whose home the death occurred,
- any person who was present at the time of death or who knows of the death.
In the case of deaths in public or private institutions, other persons who were present at the death or who know of the death also have the right to report the death. The persons obliged to report the death must provide the information required to certify the death and submit the relevant evidence. The registry office makes the entry in the register of deaths and issues the death certificate.
You will need the following documents to report a death:
- Identity card, passport or a recognized passport replacement document of the person making the verbal notification
- Written notification from the institution where the death occurred
- medical death certificate (non-confidential and confidential part)
- identity card, passport or registration certificate of the deceased person (as proof of identity (for foreigners) and last place of residence); a confirmation of registration is not sufficient
- if the deceased person is not yet listed in the civil status registers (i.e. the register of births, marriages or civil partnerships) of the registry office responsible for recording the death, civil status certificates of the deceased person:
- if the birth and any marriage of the deceased person were recorded at another registry office: Civil status certificates of the deceased person
- marriage or civil partnership certificate of the last marriage or civil partnership and, in the event of dissolution, proof of this
- if there was no marriage or civil partnership: birth certificate
Note: The registry office may request further documents from you if this is necessary to verify information. Documents from abroad must be submitted in the original and accompanied by a German translation by a recognized translator.
The following requirements must be met:
- - A person has died,
- a coroner's inquest has been held.
The notification of death is carried out as follows:
- As a person subject to notification, you notify the death verbally.
- Hospitals, retirement and nursing homes and other institutions report the death in writing.
- If you have commissioned a funeral home, they will report the death for you in writing.
