As the person responsible for blasting with explosive substances, you must report the blasting to your local regulatory authority.
Blasting with explosive substances can be, for example, blasting a building or chimney or blasting during road construction work.
You must also report any changes to the content of the notification or the documents after the notification has been made.
As the holder of a permit to purchase and handle explosive substances, you are obliged to notify the authorities.
Blasting in facilities that are approved in accordance with § 4 of the Federal Immission Control Act are exempt from the obligation to notify.
In the notification you list:
- The location, date and time of the blasting (in the case of several blasts, the period during which they are to be carried out),
- the name and address of the persons responsible for the blasting and
- Number, date and issuing authority of the valid permit in accordance with § 7 or § 27 of the Explosives Act and the valid certificate of competence in accordance with § 20 of the Explosives Act (if applicable).
Please also enclose the following information or documents:
- Description of the blasting work according to type, procedure and scope of the blasting
- technical blasting data, such as type and maximum quantity of explosives and detonating agents to be used per blast
- Distance of the blasting sites from buildings and facilities requiring special protection within a radius of at least 1000 meters, in particular from hospitals, schools, old people's and children's homes, sports facilities and playgrounds
- Safety measures, in particular cover rooms for employees, barriers along traffic routes and precautions to protect neighboring residential and workplaces against flying stones, vibrations, blasting fumes and noise
- Scaled site plan (barrier plan) or documents with information on the distance of the blasting sites from traffic routes, residential and workplaces and public supply facilities within a radius of at least 300 meters
- if required: calculation and planning documents
- if required: expert opinion
The person making the notification is the responsible person in accordance with § 19 Para. 1 No. 1. The person responsible for the actual blasting (permit or authorization certificate holder) must provide evidence of appropriate specialist knowledge.
You can submit your notification in writing or electronically.
Once you have submitted the application and all documents are complete, the competent authority will check whether all requirements for notification in accordance with Section 1 (1) of the 3rd Explosives Ordinance have been met.
If all documents are complete, you have fulfilled your obligation to notify in accordance with § 1 Para. 1 3.SprengV.
You may only carry out the blasting once you have fulfilled the notification obligation in accordance with § 1 Para. 1 3.SprengV.
If changes to the content of the notification occur after the notification has been submitted, a change notification is also required. Untimely, incomplete or incorrect notifications are an offense within the meaning of the Explosives Act.
