§ Section 7 of the Explosives Act (SprengG)
If you want to handle explosive substances in the commercial sector or operate them in traffic, you need a permit in accordance with the Explosives Act.
Activities in connection with explosive substances have a great potential for danger. The aim of the Explosives Act is to protect people and property from these dangers. In order to prevent accidents and misuse, the Explosives Act places high demands on the suitability, reliability and specialist knowledge of persons who wish to handle explosive substances.
In the context of reliability, information is obtained from other authorities, e.g. police, public prosecutor's office.
If you as an entrepreneur* wish to handle or deal with the following explosive substances, for example, you require a permit in accordance with § 7 SprengG:
- NC powder (nitrocellulose powder)
- Stage pyrotechnics / technical pyrotechnics
- Category F3 and F4 fireworks,
- Fireworks according to § 20 para. 4 of the First Ordinance to the Explosives Act of category F2
The official permit ensures that only persons who meet the requirements for safe handling have access to explosive substances. When applying for a commercial permit, the competent authority may ask you for further information on the existing storage facilities for explosive substances.

- Description of the intended storage (e.g. technical documentation, photo evidence, storage plan)
- Clearance certificate
- To check the reliability of persons from abroad: You require a certificate in the form of a certified translation from the competent judicial or administrative authority in your home country or country of origin regarding certain facts that are relevant to the assessment of your reliability (e.g. extract from the criminal record).
In order to obtain a permit to handle and transport explosive substances, you must meet the following requirements:
- You must be 21 years of age or older to handle explosive substances.
- You must have specialist knowledge. The specialist knowledge is proven by a certificate which certifies successful participation in a state or state-recognized training course.
- They must be reliable in accordance with § 8a of the Explosives Act.
- You must be personally suitable. You are personally suitable if you have no restrictions, e.g. in your mental or physical health or due to drug or alcohol addiction.
Before you as an entrepreneur are allowed to handle or deal with explosive substances, you must have been granted a permit in accordance with Section 7 of the Explosives Act.
You must submit an application and all the necessary documents to obtain the permit.
The documents will then be checked by the competent authority. If there are any questions or uncertainties, the authority will contact you and invite you to a personal interview if necessary.
Once the documents have been checked, you will receive a decision notice and a fee notice with a request for payment.
