If you have your own ideas about what a school should offer, you can get permission to run a private alternative school under certain conditions.

In Germany, freedom of private education is guaranteed in the Basic Law, which means that anyone has the right to establish a private alternative school.

However, because a private alternative school is also under the supervision of the state and its foundation is subject to conditions, an alternative school can only be founded if this has been approved in advance by the competent authority.

You must apply for approval from the competent authority in good time and enclose a number of documents with the application. You must use these documents to prove that the requirements for approval have been met.

If you have met all the requirements, you are entitled to have the competent authority grant you permission to operate the alternative school. Otherwise your application will be rejected.

Please enclose the following information with your application:

The school authority

  • Name

> Individuals: Name, address, curriculum vitae, current certificate of good conduct

> Legal entities or associations of persons: Name, legal form, registered office/address

  • Only for legal entities or associations of persons:

> Articles of association or partnership agreement

> current uncertified excerpt from the register of associations or commercial register

> List of persons acting on your behalf

  • For the individual or each acting person

> Current certificate of good conduct (Section 30 (1) of the Federal Central Register Act)

> Tabular curriculum vitae with surname and first name, date and place of birth, nationality and address

About the alternative school

  • Name of the school, school level, type of school, type of school and, if applicable, special educational focus
  • Name of the curriculum
  • Complete curriculum and timetable, if these do not correspond to the state regulations
  • for primary and lower secondary schools in accordance with § 101 Paragraph 4 Alternative 1 of the NRW School Act, a concept to justify the special educational interest
  • for schools of their own type, a description of the intended reform pedagogy and the associated deviations from the regulations specified in § 100 Para. 4 of the NRW School Act
  • Size, structure and form of organization as well as the course of education
  • for secondary schools, proof of the legally required cooperation with at least one grammar school, a comprehensive school or a vocational college

About the school building

  • List of the rooms used with details of the respective purpose and size

  • Proof that a school may be operated in the building under building law.
  • Proof that you are permitted to use the building (extract from the land register, rental agreement, rental option).
  • Proof that you are allowed to use sports facilities.

Financing the alternative school

  • Do you intend to charge school fees to the parents of the pupils and if so, how much?
  • Your budget planning for the year of the start of operations and the two following financial years
  • Proof that you will be able to cover your share of the costs during this period (e.g. by means of a bank guarantee).
  • Written and legally binding signed declaration as to whether you wish to claim rent and lease for the school buildings and premises.

Voraussetzungen

You do not need to have any previous experience in the field of schools and education to be approved to run an alternative school. You must be personally reliable (certificate of good conduct) and financially capable (proof that you can bear your share of the costs for the current and the following two financial years).

The school you are planning must be equivalent to a corresponding public school in terms of

  • Teaching and educational objectives
  • facilities (e.g. the school building)
  • academic training of the teaching staff, qualifications.

All three aspects should ultimately ensure that pupils at the end of their school career at your school can achieve the same level of education as would be possible at a state school.

The Basic Law stipulates more far-reaching requirements for primary and lower secondary schools.

Children from low-income families must also be able to attend your school. So if you want to charge school fees, parents on low incomes must also be able to afford them.

Kosten

Fees from €100 to €1,500, depending on how complex the approval procedure is.

Verfahrensablauf

The approval procedure begins after you have submitted an application to the competent authority. The competent authority will first check the application to see whether you have enclosed all the necessary documents. If this is not the case, you will receive a notification.

It is possible to submit an incomplete application initially and then send additional documents at a later date. However, please bear in mind that this will waste valuable time that the competent authority could have used to review a complete application.

As far as the documents allow, the content of your application will then be examined; various specialist departments will also be involved. For example, a building specialist will check whether the building in which you want to run your school is suitable for this purpose. Another specialist department will check whether your teaching staff are qualified and can be deployed.

These checks may result in you having to supplement your application, for example if not all teachers are sufficiently qualified and you need to find replacements for them. The responsible office will always inform you of this. This happens frequently, which is why it is very important to submit your application as early as possible. This is because the later you submit an application and can only submit documents later if necessary, the greater the risk that the responsible body will not be able to complete its review in time for the date on which you want to start operating the school.

You can only receive approval if you meet all the requirements for approval.

Bearbeitungsdauer

You should expect it to take several months. The length of the procedure depends heavily on the quality and completeness of your application documents.

Frist

Applications should be submitted to the relevant authority at least seven months before you wish to start teaching at your school.
