When conducting insolvency proceedings, procedural costs are incurred which can be considerable (court costs, remuneration for the insolvency administrator, possible remuneration for the members of a creditors' committee and the remuneration for a trustee during the subsequent residual debt discharge proceedings). Insolvency proceedings with the possibility of obtaining residual debt discharge can only be opened if these costs are covered.
These costs are covered if the debtor has sufficient assets or if an advance on procedural costs is paid by a third party (e.g. family members). Impecunious debtors who do not have sufficient assets or who do not receive an advance from third parties can apply for a deferral of the costs of the proceedings (see also Deferral of the costs of insolvency proceedings).
