§ Section 4 of the Energy Industry Act

The operation of energy supply grids is subject to approval. Approval is granted if the applicant has the necessary personnel, technical and economic capacity to operate an energy supply grid in order to guarantee grid operation in accordance with the provisions of this Act in the long term.

Cartographic representation of the network
Overview/description of the technical systems
Proof of compliance with the recognized rules of technology of the German Electrical and Electronic Manufacturers' Association,
e.g. by submitting a confirmation of technical safety management (TSM confirmation) in accordance with VDE-AR-N 4001 (S 1000) for the operation of electricity supply networks or the DVGW Deutscher Verein des Gas- und Wasserfaches e.V. (German Technical and Scientific Association for Gas and Water). - Technical
scientific association, for example by submitting a confirmation of technical safety management (TSM confirmation) in accordance with DVGW worksheet G 1000 for the operation of gas supply networks
Presentation of risk management for network operation (fault monitoring, fault rectification)
Submission of a current annual financial statement (for newly established companies: opening balance sheet, business plan and medium-term financial planning)

The applicant must use the aforementioned documents to demonstrate and, if necessary, prove that it is capable of operating an energy supply network on a permanent basis.

The applicant must submit an informal application for a permit to operate an energy supply network to the energy supervisory authority. The above-mentioned documents must be attached; if they are incomplete, they can also be submitted subsequently. The energy supervisory authority first checks the application and the documents submitted for completeness and conclusiveness. It then contacts the applicant and discusses the next steps and procedure with them.

There are no forms, the application can be made informally.
