§ Section 33c (3) of the Trade Regulation Act (GewO)

As a trader, you may only set up gaming devices with the possibility of winning prizes (goods prizes, cash prizes) if the competent authority has confirmed in writing that the installation site is suitable for this purpose.

The permit that you require for the installation and operation of such gaming devices may be subject to conditions. The conditions may relate to the installation site if this is necessary for the protection of the general public, guests or residents of the respective premises or neighboring properties or in the interest of the protection of minors.

The exact provisions regarding installation locations are set out in the Gaming Ordinance (SpielV).

A gaming machine where the prize is money (slot machine) may only be installed

• in accommodation establishments or in rooms of pubs or restaurants where drinks or food are consumed on the premises,
• in amusement arcades or similar businesses or
• in betting offices of licensed bookmakers

set up.

You may not, for example, set up a gaming machine at public festivals, fairs, in drinking establishments, ice cream bars or in pubs or restaurants located on sports grounds, in sports halls, dance schools, bathing establishments or youth hostels.

• Identity card or passport with a current registration certificate (for representation with written power of attorney: identity card or passport of the authorized representative, as well as a copy of the identity card of the person granting the power of attorney)
• For legal entities: current extract from the register

In accordance with Section 1 of the Gaming Ordinance, the installation location of a gaming device with the possibility of winning must be in a

• a pub or restaurant where food and drink can be consumed on the premises, or
• in an accommodation establishment, an amusement arcade or similar establishment and
• a betting office of a licensed bookmaker

so that the competent authority can confirm that the installation site is suitable.

Before installing gaming machines, you must apply for a suitability certificate for the installation site. The application can be made electronically or in writing.

When setting up in restaurants, the operator of the restaurant must have a restaurant license.

Once you have submitted the application and all documents are complete, the competent authority will check whether you meet all requirements.

If all requirements are met, the competent authority will confirm the suitability of the location for the installation of gaming machines.

A site inspection may be necessary if, for example, equipment is to be installed in the premises for the first time or if the premises have changed.
