§ Section 39 of the State Forestry Act (LFoG)
- You may only convert forest to another type of use with the approval of the forestry authority.
- The application must be submitted before the forest conversion is carried out and the decision on approval or refusal must be awaited.
- - Applications for a forest conversion permit are accepted by the relevant forestry offices.
- If the forest conversion is approved, the lost forest functions must be compensated for. This is usually done by reforesting areas that are not yet forest.

The approval process begins with an application from the forest owner or an authorized person. The forestry authority must first inform other authorities about the application, which can then comment on it. The district or independent city and the land consolidation authority are always informed. The regional planning authority and the Chamber of Agriculture are only informed if their interests are affected.
The decision on the eligibility for approval is made once the forestry authority has weighed up the rights, obligations and economic interests of the forest owner and the interests of the general public.
To this end, the forest owner must demonstrate that refusal of the permit would unreasonably affect him. In addition, he must demonstrate that the proposed new type of use is only possible on a forest area.
