If you come from another member state of the European Union or a country treated as such under the law of the European Communities, you may only use the title "State-recognized expert for earthworks and foundation engineering" if
- if you are either authorized to use the designation on the basis of a regulation of a state of the Federal Republic of Germany in which you have your residence, place of business or predominant employment, or
- if you fulfill the material requirements for entry in the corresponding list.
State-recognized experts for earthworks and foundation engineering support the state-recognized experts for testing stability in the field of soil mechanics and earthworks and foundation engineering by
- the subsoil deformations and their effect on structures (soil-structure interaction),
- the safety of the foundations of structures
- the assumptions made and
- the soil mechanical parameters
and certify the completeness and correctness of the information on the subsoil and its load-bearing capacity to the state-approved expert for testing stability.
As an external expert, you must notify the first-time provision of services in advance or apply for a certificate of compliance with the material requirements.
Notification of the first-time provision of the service:
- Certificate of legal establishment in a member state of the EU (or equivalent state) for the performance of the activity
- Proof of fulfillment of comparable requirements for exercising the activity in the country of establishment
Application for a certificate:
- Certificate of legal establishment in a member state of the EU (or equivalent state) for the purpose of exercising the activity
- Proof of actual fulfillment of the recognition requirements
If you are established in another member state of the European Union (or a state treated as such) to perform this task, you are authorized to work as an expert in North Rhine-Westphalia,
- if you have a comparable authorization with regard to your field of activity and
- you had to meet comparable requirements with regard to the recognition requirements and proof of knowledge, and
- if you are not prohibited, even temporarily, from exercising the activity (1st alternative) or
if the recognition authority has certified that you meet the requirements with regard to the recognition requirements, proof of knowledge and the scope of activity for recognition as an inspection expert (2nd alternative).
A further requirement is that you have a good command of written and spoken German.
- You can notify us in writing or electronically when you take up work as an expert in earthworks and foundation engineering. The required evidence must be enclosed with the notification.
- If you require a certificate in accordance with Section 4 (3) of the Ordinance on State-Recognized Experts under the State Building Code (SV-VO) and all documents are complete, the competent authority will first check whether all the requirements for becoming an expert under the Ordinance on State-Recognized Experts under the State Building Code (SV-VO) have been met.
- If all requirements are met, the relevant certificate will be issued by the competent body.
- You may only work as an expert for earthworks and foundation engineering once you have submitted the certificate from the competent authority.
The notification or application is not required if a notification has already been made or a certificate has been issued in another country of the Federal Republic of Germany.

- Use of the professional title "State-recognized expert for earthworks and foundation engineering" by persons from an EU state or a state equivalent to an EU state under EU law
- When providing the service for the first time, the applicant must prove that he/she fulfills comparable requirements for exercising the activity in the country of establishment
- When applying for a certificate, the applicant must enclose evidence of actual fulfillment of the recognition requirements
