Temporary structures are non-stationary structures that are repeatedly erected and dismantled, such as fairground rides and marquees.
For the erection and operation of temporary structures, you generally require a so-called implementation permit, which is valid in all states of the Federal Republic of Germany.
You do not need an implementation permit for
- Flying constructions up to 5 meters high that are not entered by visitors
- Children's rides up to 5 meters high and a maximum speed of 1 meter per second
- Stages up to a floor area of 100 square meters with a maximum stage height of 1.5 meters and a canopy or stage structures up to a maximum height of 5 meters
- Single-storey tents up to a floor area of 75 square meters
- single-storey walk-in sales stands with a floor area of up to 75 square meters
- inflatable structures up to 5 meters in height and with covered areas up to 3 meters in length
- inflatable structures up to 5 meters in height with covered areas up to 10 meters in length, if their descent is prevented by a separate supporting structure in the event of a fan failure
The design approval is incorporated into an inspection logbook.
The validity of a work permit is limited and can last for a maximum of 5 years. Construction permits for very complicated temporary structures are only valid for 1 year. The validity can be extended by the licensing authority following an inspection of the technical condition of the temporary structure by experts.
You will receive the building permit from the building supervisory authority in whose area your main residence or commercial establishment is located. In North Rhine-Westphalia, only the cities of Dortmund, Essen, Cologne, Soest and Bielefeld can issue building permits.
If your main residence or commercial establishment is located outside of Germany, you must apply for a building permit from the licensing authority in whose area the temporary structure is to be operated for the first time.
If you change your place of residence, change your commercial establishment or sell a temporary structure to a third party, you must notify your licensing authority and make an appointment to present and amend the inspection logbook so that the licensing authority can amend the construction permit and the inspection logbook accordingly. If the changes result in a change of responsibility, the previous licensing authority will transfer the files to the new licensing authority.

You must submit the application documents in duplicate.
An execution permit is required for any temporary structure that is not exempt from the permit requirement.
You submit an application for execution approval to the approval authority (building regulation offices of the cities: Dortmund, Essen, Cologne, Soest, Bielefeld).
If necessary, additional documents must be submitted or inspections arranged.
If necessary, the temporary structure must be erected on a trial basis.
The execution permit is issued and bound into an inspection book together with the inspected building documents, inspection reports and blank pages for use.
You will receive the inspection book with the execution permit bound in and a notification of fees.
If the binding of the book is delayed, a provisional inspection book can be created for a maximum of 9 months.
