Under certain conditions, your underage children aged 16 and over can obtain a permanent settlement permit. You can find out how to apply for this and which requirements must be met here.

You can apply for permanent residence in Germany for your child/children.

The following requirements must be met:

  • Your child was born in Germany or
  • moved to Germany with or to you as a minor/underage

and

  • Your child has held a residence permit for at least 5 years and
  • has reached the age of 16.

Erforderliche Unterlagen

  • Valid passport
  • 1 recent biometric photo

  • Proof of livelihood (original and copy)
    If you are not in school, vocational or academic training: Proof of a secure livelihood, such as
    • Employment contract, employer's certificate of employment without notice (not older than 14 days) and payslips since the last residence permit was issued or
    • Documents relating to income from self-employment.
  • In the case of minors without a school or vocational training relationship, proof of support from their parents must be submitted.
  • Proof of education (original and copy)
    The following must be submitted
    • for pupils: all school reports and a current school certificate
    • for trainees: the training contract, training certificates and a current certificate from the training position
    • for students: a current certificate of enrollment and proof of study progress (passed intermediate examinations, credit points)
  • If required: written authorization from a parent
  • In the case of joint custody, the parents must appear together and submit the application for their minor child jointly
  • If a parent with custody is unable to appear in person, they must issue the other parent with custody with a written power of attorney. With this power of attorney, the other parent can apply for a residence permit for the joint child.

Voraussetzungen

Personal appearance together with the parents

  • Children aged 16 to 17 may not submit the application themselves. They must therefore be accompanied by at least one legal representative.
  • Legal representatives are usually the parents with joint custody or the parent with sole custody.
  • Only adults who have already reached the age of 18 can submit the application themselves.

Possession of a valid residence permit

  • The residence permit must have been valid for at least five years.

Completion of the 16th year of age

The settlement permit can be issued at the earliest when you reach the age of 16.

Foreigners of legal age can also obtain a settlement permit,

  • if the entry into the federal territory for family reunification and
  • the residence permit was issued for the first time before the age of 18.

Training or secure livelihood

There must be a training relationship that leads to a recognized school, vocational or academic qualification.

This is the case in the event of proper and regular

  • school attendance,
  • in-company training
  • studies.

No criminal offenses
Even fines can prevent the granting of a settlement permit.

Vocational preparation, basic vocational training or an internship do not lead to a recognized vocational qualification.

If there is no training relationship, you must be able to support yourself without public benefits in accordance with Social Code II or XII (unemployment benefit II or social assistance).
