The purpose of the Closed Substance Cycle Management Act (KrWG) is to conserve natural resources and ensure the environmentally sound disposal of waste. The ecologically and economically optimized management of resources (including waste) is characterized by resource-saving production methods and processes for the avoidance and recycling of waste. To ensure compliance with these requirements, measurements and investigations are necessary.
Certain measurements and studies carried out after the
- Sewage Sludge Ordinance (AbfKlärV),
- Waste Oil Ordinance (Waste Oil Ordinance),
- Biowaste Ordinance (BioAbfV),
- Waste Wood Ordinance (AltholzV) and
- Landfill Ordinance (DepV)
may only be carried out by experts or investigating bodies designated (i.e. notified) by the competent authority.
The "Waste Specialist Module" of the Bund/Länderarbeitsgemeinschaft Abfall (LAGA) regulates the requirements for the competence and notification of inspection bodies (measuring and testing centres) within the framework of the KrWG and the aforementioned ordinances issued in this context. For example, requirements for the technical competence of the investigating bodies are described on the following points:
- Staffing - Guarantee of technical equipment requirements
- Internal and external analytical quality assurance via quality management
- Ensuring the guarantee of the investigations qualitatively and quantitatively according to parameters and assignment values of the legal regulations
- Employment of samplers with professional qualifications
The applicant must submit, inter alia, the following application documents:
- Curriculum vitae, certificates of vocational training, proof of previous professional activity of the laboratory manager and his representative
- Information on the number and qualifications of employees
- Information on technical equipment
- Information on whether the inspection body is recognised in other countries (proof of accreditation or approval notices from approval authorities of other countries)
- Proof of successful proficiency test participation
Existing accreditations according to DIN EN ISO/EC 17025 are considered as proof of competence, provided that they are valid and applicable and complete for the requested examination task.
Depending on the administrative burden, an administrative fee of between EUR 60.00 and EUR 1,500.00 must be paid for the designation of the investigating bodies (notification).
A query for the notified inspection bodies of the federal states is possible via the "Recherche System Messstellen und Sachverständige" (ReSyMeSa).
