If a company is founded or renamed whose company name contains the legally protected professional titles architect, landscape architect, interior designer, urban planner or urban architect or a derived designation or word formation (= professional company), a clearance certificate from the chamber vis-à-vis the partnership or commercial register is required.
On the basis of the articles of association, the list of shareholders and the proof of professional liability insurance, the Chamber of Architects and Urban Planners checks whether the legal requirements under the Hessian Architects and Urban Planners Act have been complied with. If the prerequisites are met, the Chamber issues a clearance certificate and sends it to the competent partnership or commercial register.
Upon entry in the partnership or commercial register, the professional society is entered in the professional directory of professional societies of the Hessen Chamber of Architects and Urban Planners and becomes an independent member of the chamber.
For this purpose, the following documents must be submitted to the Hessen Chamber of Architects and Urban Planners, depending on the type of company:
- Partnership company:
- Social contract
- Corporation
- Articles of association in publicly certified form (The articles of association must contain the provisions listed in § 6 para. 2 HASG
- List of shareholders
- Proof of sufficient professional liability insurance for the company
- Proof of registration with the commercial register
For the processing of an application for the issuance of the clearance certificate for the first entry in the partnership or commercial register, a fee is charged by:
- 130,00 Euro for partnership companies
- 300,00 Euro (up to 600,00 Euro with increased expenses) for corporations
