A large number of regulations must be observed during the construction, installation, modification, change of use, demolition or removal of structures.
Anyone who violates the building regulations - intentionally or negligently - is acting illegally. In addition, many legal provisions of the so-called ancillary building law contain independent provisions on administrative offences.
For example, anyone who
- violates an enforceable written order of the building supervisory authority (e.g. cessation of work, removal of facilities)
- erected, modified, used or removed buildings (structures) without the required building permit or deviating from it without the necessary indications and structural verifications
- begins with the execution of a construction project exempted from approval before the expiry of 3 weeks after the confirmed date of receipt of the documents
- begins the construction work without having received the (required) building permit and having submitted the construction certificates and the notification of the start of construction to the building supervisory authority, furthermore opposes the measures of construction supervision (requests and notification obligations)
- does not refund the notification of the start of construction or does not refund it on time
- Labels construction products with the Ü mark without the prerequisites being met
- Construction products without Ü mark used
- applies types of construction without general technical approval, general technical test certificate or approval in individual cases
- violates his legal obligations as a builder, draftsman, contractor, construction manager or as their representative
- provides incorrect information against better knowledge or submits incorrect plans or documents in order to obtain or prevent an official decision (e.g. a building permit or disposal order)
In cases of doubt, it is therefore recommended to contact the responsible building supervisory authority or the municipality before carrying out an activity relevant to building law.
(Construction) Administrative offences can be punished with a fine of up to 500,000.00 euros.
The decree "Administrative offences in building regulations" contains specifications for the calculation of the fine.
