Anyone who wants to handle or trade explosive substances needs a permit. A permit can only be issued if the reliability has been checked beforehand.
You need a permit in accordance with § 7 of the Explosives Act (SprengG) in order to handle explosive substances commercially or independently within the framework of an economic enterprise or an agricultural or forestry operation or to operate the traffic there.
Handling includes the manufacture, processing, processing, recovery, storage, transfer, use and destruction of explosive substances. The transport, the transfer and the receipt within the business premises is also included in the handling.
Traffic includes the making available on the market, the acquisition, the transfer and the brokering of the acquisition, distribution and transfer of explosive substances.
Permission shall be granted upon application by the competent authority.
The issuance of the permit is subject to a fee.
When checking the reliability, information is requested from the following offices: Federal Central Register, Central Trade Register, Public Prosecutor's Office Register of Proceedings, State Criminal Police Office, Office for the Protection of the Constitution and, if applicable, Foreigners' Registration Office.
The official permit ensures that only those persons who meet the requirements for safe handling and traffic are granted access to explosive substances.
When applying for a commercial permit, the competent authority may ask you for further information on the available storage facilities for explosive substances.
In order to obtain a permit to handle and trade explosive substances, you must meet the following requirements:
- They need to be reliable. The required reliability is usually given if you have previously behaved in a lawful manner and have no criminal record.
- They must have suitable rooms or storage facilities for storage.
- Liability insurance with sufficient coverage is required.
- To be granted, you must submit an application and all the necessary documents.
- The documents are then examined by the competent authority.
- If you have any questions or uncertainties, the authority will contact you and, if necessary, invite you to a personal interview.
- After reviewing the documents, you will receive a notice of the decision, the certificate of permission and a fee notice with a request for payment.
The responsible person entered in the permit is checked for reliability on a regular basis and for a fee.
Changes affecting the permit must be notified to the competent authority without delay.
The licence expires if the holder of the licence has not commenced the activity within one year of the licence being granted or has not carried it out for two years. The time limits may be extended by the competent authority for specific reasons.
