If a building that is important for the real estate cadastre has been newly erected or changed in its floor plan, there is a legal obligation to arrange for a building measurement until completion of the shell.
Ownership of land is subject to state warranty. For this reason, the Hessian offices for land management maintain a property cadastre for the state-wide verification of all land and buildings, in which the property boundaries and the building floor plans are documented in high quality and accuracy on the basis of local surveys. The real estate cadastre thus also serves to protect your personal property rights.
In order for the Land Management Offices to be able to keep the building record in the real estate cadastre up to date at all times, the legislator has obliged the owners of newly constructed or ground-plan buildings to commission an authorised surveying body (publicly appointed surveying engineer, Office for Soil Management) with the fee-based survey. The commissioned surveying body shall initiate a corresponding procedure for this purpose.
If the shell has been completed and the building measurement has not been commissioned despite a written request, the surveying bodies are entitled to act (ex officio) even without an order and to invoice the building owners for the costs. The surveying bodies are required to initiate a building measurement procedure ex officio even without prior written request from the building owners if they already have to carry out another survey on the property concerned upon request or if the building concerned is to be represented in a building template to be prepared by them.
In the case of authorisation to apply:
- Presentation of the corresponding power of attorney
In the event that the costs are covered by a third party:
- Declaration of assumption of costs
You can submit an application for building measurement if you:
- Building owner
- or are authorized by the above group of persons.
Note: The costs are collected uniformly by all surveying agencies according to the administrative costs regulations for the business area of the Hessian Ministry of Economics, Energy, Transport and Housing (VwKostO-MWEVW).
Additional costs are incurred for the transfer of the survey results into the real estate cadastre.
The amount of the fees is determined depending on the value of the building or the structural change (shell construction sum)
- Upon receipt of the request, a consultation will be given and, if desired, a cost estimate.
- Preparation and coordination of a measurement date.
- Execution of the building measurement on site.
- Cost determination of the building measurement by the surveying office.
- Transfer of the survey results into the real estate cadastre.
- Cost determination of the transfer to the real estate cadastre by the Office of Land Management.
- Sending the information on the continuation of the proof of the buildings in the real estate cadastre and a current edition of the property map

- If a building is newly erected or the floor plan is changed, there is a legal obligation to apply for a building measurement until completion of the shell.
- The following persons are eligible to apply:
- Building owner
- persons authorised by the above-mentioned group of persons
- Detailed questions about the application may have to be clarified with the applicant by a competent surveying office (scope of services, cost estimate, etc.).

Building measurements are carried out by publicly appointed surveyors approved in the state of Hesse or by the respective responsible offices for soil management.
If you do not fulfil your obligation to commission a building measurement in time until the completion of the shell construction, these bodies can also act without an order (i.e. ex officio) after prior request and the expiry of a period of 21 days.
