Erstaufforstung Genehmigung

If you are planning the creation of new forest and the afforestation of forest meadows, you must submit a corresponding application.

The creation of new forest and the afforestation of forest meadows may only take place with the prior consent of the competent authority under Land law. If you are planning such a project and submit a corresponding application, the competent authority, with the participation of the lower forestry authority (as well as other specialist authorities involved), checks whether the legal requirements are met. After receiving the respective approval, you can implement your plans.  

Your application for new forest creation will be examined and decided by the magistrates in the district committees of the districts or in the independent cities. Other specialist authorities (such as the forestry office as the lower forestry authority) are involved in the procedure. In the case of areas of more than five hectares, the decision is also taken in consultation with the regional planning body and the higher forestry authority.

The authorisation may be granted for a limited period and subject to conditions.

Informal written application:

• Applicant (name, address), date, signature
• Description of the purpose for the creation of new forest or the afforestation of forest meadows
• Justification for the project
• Information on the planned period of implementation
• Information on planned tree species
• Information on the area for which a new forest or afforestation of a forest meadow is planned:
  • Gemarkung, Flur, Flurstück(s)
  • Area size
  • Site plan or map as aerial photo with marked area
  • Proof of ownership (copy of land register)
  • Indication of current usage
     

Costs: 100,- Euro per hectare.

The costs are laid down in the Administrative Cost Regulations for the portfolio of the Ministry of the Environment, Climate Protection, Agriculture and Consumer Protection (VwKostO-MUKLV) - as amended.

You submit your application with the required documents to the competent approval authority.

The further procedure is as follows:

1. Examination of documentation by the approval authority
2. Establishment of agreement with the specialist authorities to be involved
3. Examination and, if necessary, inclusion of conditions and decision on the application
4. When the permit is granted, the approval notice will be sent to you

• In the case of areas of more than five hectares, approval is granted in consultation with the regional planning authority and the higher forestry authority.
• Authorisation may be refused only if:
  • interests of regional planning and regional planning,
  • Interests of agriculture
  • the interests of nature and landscape protection are endangered, or
  • considerable disadvantages for the environment are to be feared.
• It may be granted subject to conditions.
• The permit includes other decisions under public law concerning the creation of new forests.
• Where afforestation is envisaged as replacement afforestation:
  • this may also be carried out in advance in accordance with the rules on the eco-account.
  • with the proviso that the lower nature conservation authority must establish consultation with the lower forestry authority
