For larger construction projects, send an advance notice to the responsible occupational health and safety authority at least two weeks before setting up the construction site. You must also display this advance notice visibly on the construction site and adapt it in the event of significant changes.

As the client, you or your authorized third parties must give advance notice to the competent occupational health and safety authority at least two weeks before setting up the construction site if

• the expected duration of the work is more than 30 working days and more than 20 employees are scheduled to work on the construction site over a period of at least one shift at the same time, or
• the scope of the work is expected to exceed 500 person-days, whereby one person-day comprises the work performed by one person over one shift.

Setting up the construction site begins with the essential preparatory work at the site of the construction project that is required immediately before it is carried out, for example setting up social facilities, installing supply and disposal facilities, delivery of building materials, machinery and equipment.

You must also post the advance notice visibly and legibly on the construction site so that it is unaffected by external influences and the weather.

In the event of significant changes, you must update the posted advance notice. It is not necessary to resubmit it to the relevant health and safety authority.

Significant changes that require an adjustment to the advance notice are, for example

• Change of client or commissioned third parties,
• First-time appointment of a coordinating person or subsequent change of this person,
• shortening the duration of the construction work if this means that more work has to be carried out at the same time or in unplanned shifts,
• first-time involvement of employees from several employers or use of subcontractors,
• a significant increase in the maximum number of simultaneous employees or the number of employers or the number of companies without employees.

• Advance notice

• The expected duration of the work is more than 30 working days and more than 20 employees are scheduled to work on the construction site at the same time over a period of at least one shift, or
• the scope of the work is expected to exceed 500 person-days, with one person-day comprising the work performed by one person over one shift.

There are no fees.

Check whether advance notice is required.

If advance notice is necessary:

• Compile the necessary information.
• Send the advance notice to the responsible health and safety authority.
• Post the advance notice on the construction site as soon as construction site set-up begins.
• In the event of significant changes to the content of the advance notice, check whether you need to adapt the posted advance notice and replace it immediately.

• Transmission of the advance notice: no later than 2 weeks before the construction site is set up
• Posting of the advance notice: at the latest when the construction site is set up

Rule of thumb: Advance notice is generally required if the construction activities require the deployment of at least 4 employees over a period of more than 6 months.

You are in breach of regulations if you deliberately or negligently fail to provide the competent authority with the necessary advance notice, or do not do so correctly, completely or in good time.
Check whether you need to prepare a health and safety plan (SiGe plan) and a document for subsequent work in addition to the advance notice for setting up a construction site.

If significant changes occur, the advance notice must be updated at the construction site.

Significant changes in relation to the content of the advance notice (Annex I, Construction Site Ordinance) include

• Change of client(s) or third party appointed by the client in accordance with § 4 BaustellV.
• First-time appointment of the coordinator or change of the already appointed coordinator(s).
• Shortening the duration of the construction work if this means that more work has to be carried out simultaneously or in unplanned shifts.
• Employees of several employers working together for the first time.
• Significant increase in the maximum number of simultaneous employees or the number of employers or the number of contractors without employees.

  • Scope of work expected to exceed 500 person days
