If you have already consented to your adoption or stepchild adoption before the family court, which has not yet been finally pronounced, you can revoke your consent. This requires public certification.
For an adoption or a stepchild adoption, the consent of the child is generally required. If you consented to adoption as a child or stepchild and now decide against adoption, you can revoke your consent if the adoption is not yet effective.
This only applies to children who are already 14 years old and have given their consent themselves. If you are under 14 years of age or incompetent, your legal representative has consented to the adoption.
In order for the revocation of your consent to be legally effective, it must be notarised by a registrar. To do this, please contact the adoption agency of the locally responsible youth welfare office. You can also have the declaration of revocation certified by a notary (subject to a charge). The certification at the Youth Welfare Office is free of charge. The notarization is important so that you are informed about the legal effect of the declaration of revocation and the revocation is not reckless.
The right to withdraw consent is not subject to any condition or justification. The revocation must be made to the family court.
