If you want to sell or offer goods or services commercially outside your business without being asked by a customer, or if you want to carry out entertaining activities as a showman, you must apply for a traveling trade license.

You operate a traveling trade if you offer goods for sale commercially without a prior order (appointment) and operate outside your commercial establishment (Section 4 (3) GewO) or without having one. The same applies if you solicit (sell) orders for goods or purchase goods, offer services or solicit orders for services or carry out entertaining activities as a showman or in the manner of a showman.

However, there are also activities that can be classified as itinerant trades but do not require a permit. You do not require a traveling trade license in the following cases:

• You occasionally offer goods for sale at trade fairs, exhibitions, public festivals or on special occasions with the permission of the competent authority;
• You sell home-grown products from agriculture and forestry, vegetable growing, fruit growing and horticulture, poultry farming and beekeeping as well as hunting and fishing;
• You carry out one of the activities listed in § 55 Para. 1 No. 1 of the Trade, Commerce and Industry Regulation Act in your municipality of residence or in the municipality of your commercial establishment, provided the municipality has no more than 10,000 inhabitants;
• You sell milk or milk products on the basis of a license pursuant to § 4 of the Milk and Margarine Act.
• They broker or conclude insurance contracts as insurance intermediaries within the meaning of Section 34d (6) or (7) numbers 1 and 2 of the Trade, Commerce and Industry Regulation Act (Gewerbeordnung) or building society contracts or advise on insurance within the meaning of Section 34d (2) sentence 1 in conjunction with Section 34d (7) sentence 2 as insurance advisors or are employed in the business operations of such.
• They exercise a trade requiring a license under federal or state law, for the exercise of which reliability is required, and already have the required license;
• They broker financial investments as financial investment brokers or advise third parties on financial investments within the meaning of Section 34f (3) no. 4, also in conjunction with Section 34h (1) sentence 4 GewO, or are employed in the business of such a broker;
• They broker real estate loan agreements or advise third parties on such agreements within the meaning of Section 34i (4), also in conjunction with Section 34i (5) of the Trade, Commerce and Industry Regulation Act;
• You sell food or other everyday goods from a non-fixed sales outlet or another establishment at regular, shorter intervals at the same location;
• You offer printed matter for sale on public paths, streets, squares or other public places.
• They seek out other persons as part of their business operations.
• You are active at an event in accordance with Title IV (trade fairs, exhibitions, markets) as defined in Section 69 GewO.

• Identity card or passport with registration certificate from the municipality of residence
• Certificate of good conduct for submission to authorities from the registration office of the main place of residence
• Extract from the central trade register from the registration office of the main place of residence
• Certificate in tax matters from the responsible tax office
• In the case of legal entities, a certificate in tax matters from the tax office for these as well
• If applicable, extract from the commercial register of the country in which the principal place of business is located (only for legal entities)
• If necessary, a translation of the extract from the commercial register (only for foreign legal entities)

• The issuance of a traveling trade license requires the applicant to be reliable in terms of trade law.

Is based on the respective administrative fee schedule of the federal state or on the fee statutes of the authorities responsible under federal state law.

You can apply for a traveling trade license from your municipality or city administration/trade office. To do so, contact the municipality or city administration in which you have your habitual residence or in which the future business will be based.

Approx. 1 - 3 weeks if all documents are complete.

The activity may only be commenced once the travel trade license has been issued.

In some cases, you may also need to submit additional documents or evidence. Please clarify this with your responsible office.

In the case of legal entities (limited liability companies, business companies, public limited companies, registered cooperatives), the application form only needs to be completed for the legal entity itself. All personal documents must be obtained for all natural persons authorized to manage the company (e.g. certificate of good conduct for submission to authorities) or submitted (e.g. identity papers).

In the case of partnerships that are not themselves eligible for a permit (GbR, KG, OHG, PartG, GmbH & Co. KG), each managing partner requires a permit (travel trade card), meaning that an application form and all personal documents are required for each person.
