The operation of a betting broker requires official permission in accordance with the Hessian Gaming Act (§ 10 Abs. 8 HGlüG).

According to § 10 Abs. 7 HGlüG, this permit can only be applied for by the holder of a sports betting licence pursuant to §§ 4a to 4e in conjunction with §§ 10a GlüStV. Therefore, this service is aimed exclusively at them. If you are interested in operating a betting shop as an intermediary, please contact a licensed operator.

Applications for the granting of a licence to operate a betting broker which are not submitted by a licensed organiser are to be rejected as inadmissible subject to a fee.

In addition to the application form, the applicant (sports betting concessionaire) must submit further documents:

Documents on the operator of the betting shop (intermediary):

1. Extract from the trade register (business registration),

2. If applicable, excerpt from the commercial register of the operator,

3. Excerpt from the Central Trade Register according to § 150 Abs. 5 Gewerbeordnung (GewO) for submission to authorities (not older than three months), to be sent directly to Regierungspräsidium Darmstadt, Dezernat III 34 - Glücksspiel, Preisprüfung, Luisenplatz 2, 64283 Darmstadt (please also specify: name of the organizer of sports betting); in the case of legal entities, also for all legal authorised representatives of the operator as well as for the person responsible on site,

4. Certificate of good conduct pursuant to § 30 Abs. 5 Bundeszentralregistergesetz (BZRG) for submission to authorities (not older than three months), to be sent directly to Regierungspräsidium Darmstadt, Dezernat III 34 Gambling, Price Audit, Luisenplatz 2, 64283 Darmstadt (please also specify: name of the organizer of sports betting); at

legal entities for all legal representatives of the operator as well as for the person responsible on site,

5. clearance certificate from the respective responsible tax office (not older than 3 months), in the case of legal entities also for all legal representatives of the operator as well as for the person responsible on site,

6. Printout from the common enforcement portal of the Länder that there is no entry in the debtor register, in the case of legal persons also for all legal representatives of the operator as well as for the person responsible on site.

Documents for each individual betting exchange:

1. Rental agreement for the premises of the betting shop,

2. Submission of the copy of the building permit with the floor plans approved by building law, in which all premises belonging to the operation are shown (this also includes corridors, staircases and staircases, counter equipment, etc.) including the escape routes provided with dimensions within the operating rooms to the open air as well as a description of the equipment of the betting shop and the construction usage permit,

3. Map of the betting shop in the building or complex of buildings, including the drawing and naming of any gaming halls or casinos (only if applicable),

4. photos of the operating room and the entrance area,

5. Plan-like presentation of the location of the betting shop in the municipality with marking and naming of surrounding educational institutions for children and young people, youth work facilities, as well as addiction counselling and addiction treatment centres within a radius of 200 m.

Documents relating to compliance with player protection requirements:

1. Presentation of the social concept of the sports betting operator / operator,

2. training certificates within the meaning of § 6 sentence 2 GlüStV for the operator and the person responsible on site; if already available, training certificates for the staff employed in the betting shop,

3. List of game-relevant information (including information about addiction risks) and information on how it is presented in the betting shop (§ 7 GlüStV),

4. For connection to the player blocking system OASIS GlüStV, the form location and contact person must be submitted for each location. This is available for download on the homepage of the Darmstadt Regional Council.

Valid concession of the Regional Council in Darmstadt as organizer of sports betting

The processing of the application and the granting of the permit is subject to a fee according to §§ 1-2 and § 4 Hessisches Verwaltungskostengesetz (HvwKostG). According to item 4314 of the list of administrative costs annexed as an annex to the Administrative Costs Regulation for the business area of the Hessian Ministry of the Interior and Sport (VwKostO-MdIS), there is a fee framework of EUR 52.00 to EUR 1,100.00 for the granting of a licence to operate a betting shop pursuant to Paragraph 10(8) of the HGlüG.

In the event of withdrawal of the application, up to 50 percent, in case of rejection up to 75 percent, of the permit fee to be determined, plus the expenses, shall be charged.

The average processing time is approx. 6 weeks, in individual cases up to 3 months

An appeal against the decision on the application (permission / rejection or withdrawal) can be brought before the competent administrative court.
