Surveyors take on certain tasks in mining that arise from the Federal Mining Act and the Markscheider Mining Ordinance, such as surveying in mining, assessing safety-relevant geological and geotechnical conditions and can certify facts of public faith with the so-called cracks they produce.
Insofar as the so-called "other documents" are sufficient for surface operations instead of cracks, consisting of the components of the pit pattern and other documents, these can be prepared and added by "other persons" (as mine surveyors). These "other persons" require the recognition of the competent authority for individual establishments. A pit pattern is only not required if the mining contractor has received an exemption from the pit profile requirement from the competent mining authority.

According to § 4 para. 1 of the Mining Competence and Recognition Ordinance, the competent Darmstadt Regional Council decides within a period of 3 months. Reference is made to § 42a (2) to (4) of the Hessian Administrative Procedure Act.
In order to be recognised "as another person", the competent authority shall check:
- whether the professional qualification meets the requirements
- whether at least 2 years of subject-specific professional activity has been carried out after the professional qualification
- whether there is another qualification that covers surveying knowledge and whether the additional knowledge and skills required for the preparation and completion of the other documents have been acquired in at least 3 years of subject-specific professional activity
- the required reliability
- the required physical aptitude
- Granting or refusal of recognition by means of a decision.
