The general partnership (OHG) is a partnership whose purpose is aimed at the operation of a commercial business under a joint company. It consists of at least 2 partners, there is no upper limit to the number of partners. The establishment of the OHG is not dependent on a certain minimum capital.
The OHG does not have its own legal personality. The partners are liable without limitation with their private assets.
Commercial law stipulates that an OHG must be entered in the commercial register. The registration must be made by all shareholders at the competent register court.
Content of the application:
- Surname, first name, date of birth and place of residence of each partner
- Company name, as well as the place where it has its registered office and the domestic business address
- Object of the company, if it does not result from the company
- Power of representation of the shareholders

The amount of the fee for registration is determined by the Act on Costs of Voluntary Jurisdiction for Courts and Notaries (GNotKG) in conjunction with the Ordinance on Fees in Commercial, Partnership and Cooperative Register Matters. In addition, expenses are incurred for the public announcement of the registration.
