Art. 99 of Regulation (EU) 2016/2031

If you wish to issue other attestations within the meaning of Art. 99 of Regulation (EU) 2016/2031, you require authorization to do so. You can find out more here.

The competent authority shall keep a register of companies authorized to issue attestations in accordance with Article 99 of Regulation (EU) 2016/2031 (Plant Health Regulation).

Upon request, companies may be authorized to issue other attestations with the exception of the marking of wood packaging material.

• The application must fulfill the conditions required in the respective ordinance for certification.

• The prerequisite for authorization within the meaning of Art. 99 of Regulation (EU) 2016/2031 is the registration of the company in accordance with Art. 65 (1) of Regulation (EU) 2016/2031 and, depending on the respective attestation, the fulfilment of any other requirements.

• There may also be necessary inspections.

• The contact persons named in the registration application must have appropriate knowledge of plant health in accordance with the activity carried out by the operator and be personally available to the staff of the competent authority if required.

Depends on the administrative fee schedule of the respective federal state.

• Once the required application has been submitted, the competent authority examines it.
• If the examination is positive, the company is entered in the register.

• If you change your contact details, you must submit an application to update your entry in the register within 30 days.
• Any changes to the information on the product groups, plant species, genera or families that are produced or traded, as well as the location of the cultivation areas and business premises, must be updated annually by April 30. If there are no changes, there is no need to submit an application for an update.
