If you wish to operate a restaurant, you must notify the competent authority in writing four weeks before the start of operations. Depending on the country and state regulation, you must provide additional information on alcoholic beverages or prepared food in addition to the business notification in accordance with Section 14 (1) GewO.
Accordingly, you must state the type of business and whether you intend to offer alcoholic beverages.
The following evidence must be provided:
- Identity document of the applicant (identity card or passport)
- If applicable, residence permit with the note "Gainful employment permitted" if the applicant does not come from a country of the European Union, the European Economic Area (EEA) or Switzerland
- Current confirmation of registration, if applicable, if no private address is noted in the identification document
- If applicable, registration with the Chamber of Crafts: In the case of craft or craft-like activities, registration in the Chamber of Crafts register is required for the exercise of a trade
- For trades requiring a permit: Copy of the relevant permit or license
- If applicable, a current extract from the commercial register (if already entered in the commercial register) or
- Copy of the notarial certification of the articles of association/incorporation agreement, if applicable)
Supplementary information for the notification in the hospitality industry:
- The notification must state the surname, first name and address of the operator, the place and time of the start of operations, the type of food and drink intended for sale and the type of operation. It must also be stated whether the intention is to serve alcoholic beverages.
- If alcoholic beverages are to be served, further documents must be submitted.
- Proof of requested certificate of good conduct
- Proof of requested information from the central trade register for submission to the authorities
- Tax clearance certificate
- In order to fulfill the notification requirement, you must enclose all of the above documents with the application form.

- You must register the start of a permanent business (here: restaurant business) with the competent authority. The same applies to the operation of a branch office or a dependent branch.

- If you register your business in writing or electronically, you will receive confirmation of your business registration (the so-called "trade license") within 3 days, provided you have filled out the registration form completely and correctly. - The responsible office forwards the business registration to other offices such as the tax office, the Chamber of Crafts or the Chamber of Industry and Commerce, the registration court and the employers' liability insurance association.

- In the case of written or electronic registration: within 3 days, provided the business registration form has been filled out completely and correctly and the required documents have been submitted.

The obligation to notify applies accordingly to the operation of branch offices, a dependent branch office, the relocation of the business premises, the expansion of the range of services and the discontinuation of the business.
