§ 15c paragraph 2 and Annex I number 4.2.1 Hazardous Substances Ordinance (GefStoffV)
As an employer, you must notify the competent authority of the use of certain particularly hazardous biocidal products.
Activities involving certain particularly hazardous biocidal products may only be carried out by employees who have the relevant expertise for the biocidal product in question or who carry out these activities under the direct and constant supervision of a competent person.
These biocidal products include products that are classified as
- acutely toxic category 1, 2 or 3,
- carcinogenic, germ cell mutagenic or toxic for reproduction category 1A or 1B or
- specifically target organ toxic category 1 SE or RE or
- for which, in addition to the above cases, the user category "trained professional user" has been defined for the intended use in the authorization.
As an employer, you must notify the competent authority of the first use of such biocidal products or the start of renewed use after an interruption of more than one year.
- Copy of the identification document
- Copy of the certificates of competence or other qualifications in accordance with Annex I Section 4.4 (2) of the Hazardous Substances Ordinance (GefStoffV) of all competent persons
- If applicable, copy of the certificate(s) of attendance of the most recently attended further training event(s) in accordance with Annex I Section 4.4 (5) GefStoffV of all competent persons if certificates of competence are older than six years.
- Data on the company and the biocides used
- Information on the company's safety equipment (e.g. application equipment, measuring devices, first aid facilities)
- Floor plan of the business premises / branch
Biocidal products pursuant to Section 15c (1) may only be used by persons who have the relevant expertise for the biocidal product in question. The requirements for expertise depend on the type of product, the uses for which the biocidal product is authorized and the potential risk to humans and the environment.
These biocidal products according to § 15c para. 1 include products that are classified as
- acutely toxic category 1, 2 or 3,
- carcinogenic, germ cell mutagenic or toxic for reproduction category 1A or 1B or
- specifically target organ toxic category 1 SE or RE or
- for which, in addition to the cases mentioned above, the user category "trained professional user" has been specified in the authorization for the intended use.
Deviating from this, expertise is not required for the use of biocidal products if these activities are carried out under the direct and constant supervision of a competent person.
- You submit the notification for the use of certain biocidal products to the competent authority.
- The notification must be submitted at least six weeks before the start of use.
- Once the deadline has been met, the activities can begin.
- In principle, no confirmation is issued by the authority
If use is interrupted for more than one year, the competent authority must be notified of renewed use.
In principle, there is no confirmation by the authority.
For biocidal products that were allowed to be used without expertise under the old version of the GefStoffV and that require expertise under the new version of the GefStoffV (i.e. as of July 21, 2021), the expertise requirement does not apply until July 28, 2025. (i.e. as of July 21, 2021), the expert knowledge requirement will only apply from July 28, 2025. This regulation also applies to uses of pesticides that were previously permitted without expert knowledge due to the exception in Annex I No. 3.1 of the old version of the GefStoffV (use on own premises). (use on own premises) were previously allowed to be used without specialist knowledge and now require specialist knowledge under the new version of the GefStoffV.
